"Scan the code for 1 yuan to smoke the mobile phone", "smoke one box of instant noodles for free" and "smoke three pairs of warm socks for free"... Recently, many consumers reported to the reporter of workers' daily that there were small advertisements similar to two-dimensional code on the received express box, but after scanning, it was found that they needed to fill in personal information, pay postage, bargain and so on to receive "free" goods. These two-dimensional code small advertisements are like "psoriasis", which flow with the express box**
Anhui Consumer Protection Commission once analyzed 1111 samples of express orders and found that 674 samples contained QR code small advertisements, accounting for 60.67%. Among them, the most advertisements are "receiving cash every day and receiving money every second", accounting for 39.32%.
Ms. Gao, who lives in Chaoyang District, Beijing, reported that she had participated in the activity of "receiving cash every day and making payment in seconds" by scanning the QR code on the express list. "We need to constantly invite friends to help, get lucky draw opportunities, and then continuously accumulate, exchange and link up through drawing gold coins and lucky values, so as to make up for the withdrawal amount." Ms. Gao said that after she invited nearly 20 friends to help, she still failed to withdraw cash, and no one from other participants finally withdrew cash.
"Don't sweep. It's a lie." During the interview, the dispatchers of several express companies warned that the QR code on the express box may be a false advertisement. But they said that the advertisement on the express box was not posted by them, "when it was delivered to the network".
The reporter then contacted an e-commerce platform merchant and took and uploaded pictures of QR code small advertisements on the express box sent by the store. The customer service replied that the express orders were printed by the printing system provided by the contract party. Although the QR code small advertisement appeared on their express box, it was not pasted by them. It is likely that the advertisement implantation template exists in the third-party printing software.
An insider in charge of placing express list advertisements said that they have cooperation with e-commerce platforms and express companies, and businesses can print out the express list with additional advertisements directly through the system.
Many consumers complained that they negotiated with the express company after being cheated. The other party said that the advertisement was not released by themselves and did not need to be responsible for it.
In this regard, Liao huaixue, a partner of Taihe Thai law firm, believes that advertising companies, as advertising operators and express companies, as advertising publishers, should be responsible for the advertising content if they cooperate to publish false advertisements on express boxes. If consumers cause damage due to false advertising, they can bring a civil lawsuit against the advertiser to claim compensation for the losses, or they can require the express company of the advertising publisher to bear joint and several liability for compensation.
Liao huaixue said that the market supervision department should strengthen supervision and deal with the illegal acts of express box advertising in a timely manner according to law. All parties in the express box advertising industry chain, including advertisers, e-commerce platforms and express companies, should strictly abide by the requirements of advertising law, consumer rights and interests protection law and other laws and regulations, establish an advertising content review mechanism and strengthen the review of advertising content.
Liao huaixue reminded that consumers should enhance their awareness of self-protection and rights protection. When they see the contents of "free pumping", "1 yuan pumping" and "low price exchange" in the advertisement on the express box, they should be careful not to scan the code easily.
