According to the lawsuit filed in the Central District Court of California, the man's family exercised the right to withdraw the copyright of the story in 2018, which took effect in 2020.
The plaintiff argued that paramount had not regained the film copyright from shosh and Yuval yonay (Ehud yonay's widow and son) before the release of top gun 2: Lone Ranger, and filed a lawsuit to the central California District Court of the United States, saying: "on January 24, 2020, according to the copyright law, the copyright of the story was therefore returned to yonays, but paramount deliberately ignored this point and scoffed at the regulations."
Paramount responded to the lawsuit in a statement on the deadline, saying, "these statements are groundless, and we will fully defend ourselves."
According to the lawsuit, in 1983, the California magazine published Ehud yonay's article entitled "top gun", which tells the story of naval pilots "in a very vivid and cinematic way".
Marc toberoff, a lawyer of the yonay family, also said in a statement that the law gives authors the ability to "obtain economic benefits from their creations and participate in the fruits of their labor in a meaningful way". If the lawsuit continues, it can only mean that paramount can still release derivative works of yonay's original story, but only after it obtains the copyright again.
"Paramount kept silent," toberoff said. "They didn't even have any attempt to spend money to re license the copyright of the story."
According to the lawsuit, paramount responded to the stop letter sent by the yonay couple in May, but denied that top gun 2: lone ranger was an "obvious derivative" of the story of yonay magazine.
