Apple has agreed to settle a six-year class action lawsuit accusing apple of deliberately reducing the speed of iPhone 4S devices after IOS 9 update in 2015 and agreeing to pay a claim of $15 per person to some iPhone 4S users suffering from poor performance. The class action lawsuit was originally filed by the plaintiff on behalf of a group of iPhone 4S customers in New York and New Jersey in December 2015.
The lawsuit accused apple of falsely marketing IOS 9 updates and providing confusing performance descriptions on its supported devices.
In this lawsuit, the plaintiff filed a collective execution indictment, claiming that when consumers came into contact with Apple's so-called false description of the new operating system, they downloaded IOS 9 to their iPhone The group was injured while on the 4S equipment. The plaintiff believed that Apple falsely stated that IOS 9 was compatible with iPhone 4S and would improve or "improve" the performance of customers who downloaded the software update. On the contrary, the plaintiff believes that IOS 9 has greatly reduced the performance of their iPhone 4S device.
Apple promoted IOS 9 with the slogan of "the most advanced mobile experience", with updates including active Siri suggestions, sliding screen, split view, iPad Picture in picture, etc. On the iPhone, Apple also promised to "bring faster response performance". The class action lawsuit believes that this statement is a false marketing of iPhone 4S, which is the oldest iPhone that IOS 9 can support.
According to the settlement agreement, apple paid $20 million to compensate iPhone 4S owners in New York and New Jersey for poor performance after updating to IOS 9. However, customers who think they are entitled to $15 must submit an affected process statement describing the significant decline in performance after downloading IOS 9 or any version thereof to their iPhone 4S, and are entitled to a payment of $15 per applicable device.
Apple will set up a website where customers who believe they are entitled to a settlement will be able to submit a form providing their name, email, iPhone 4S serial number (if possible) and mailing address.
